The Housing Opportunities through Modernization Act (HOTMA) was signed into law by President Obama on July 29, 2016. HOTMA makes numerous amendments to Sections 3, 8, and 16 of the United States Housing Act of 1937(1937 Act), including significant changes to income calculation, net family assets, and income reviews. HUD finalized HOTMA rulemaking in 2023 to put Sections 102, 103, and 104 into effect through revisions to HUD's regulations found in 24 CFR Part 5 and 24 CFR Part 891. Public Housing Authorities have been advised that full implementation of HOTMA has been delayed until further notice. Partial implementation for income exclusions, definition changes, and De Minimis Error, took effect July 1, 2025. Full implantation of HOTMA is expected to begin effective January 1, 2027. The HOTMA changes will go into effect with all program participant annual recertifications effective Jan. 1, 2027, and after, depending on your household’s currently scheduled annual recertification date. This will be reflected in the paperwork you receive to complete for your annual recertification, approximately 120 days prior to your effective date.
